Bensalem Township Council approved construction of 39 residential townhomes on Byberry Rd, located opposite of Amwell Road.
The approval happened at the townships council meeting on Dec. 8th, and is the second construction approval they voted on alongside the homes on 1186 Byberry Rd.
Developer Byberry-39, LLC – “Byberry Woods” was seeking approval of its land development improvements and stormwater operations & maintenance plans.
Construction on the property hasn’t started as building has been held up by factories such as environmental concerns and Covid-19.
During public comment, resident Luchra Maril brought up concerns about contaminants in the area affecting the surrounding area, siting an alleged email from 2020 that stated the construction site was significantly contaminated with some sort of material that was not made public at the time to neighbors in the area.
Council Solicitor Joseph Pizzo said he was not aware of what the nature of the reported contamination on the site was, but at the time of approval it was agreed upon by the township and the developer that the site would have to be cleaned up.
“The Townships requirement of approval at the time was that the site had to be cleaned up to the specifications of the department of environmental protection.”
Maril responded that he wanted confirmation that whatever containments there were in the area was addressed or warned about to neighbors before the ground on the project would break, as there would be rain run off that would go into the surrounding area.
Pizzo assured the council that whatever containment concerns there were, have already been addressed as the agreement for stormwater practices and land development improvements wouldn’t have come forward to the council if they haven’t been settled.
“It was very much an issue at the time, it was very much apart of the conversation at the time, and very much a requirement at the time that the property had to be cleaned to the satisfaction of the Department of Environmental Protections.” Pizzo stated.
No word on when construction at the site will begin
