A 32 year-old Bristol man is behind bars charged with one felony count of raping an unconscious woman, 30 counts of indecent assault, a single count of invasion of privacy and 30 related summary offenses.
On-call District Judge Michael W. Petrucci arraigned Gino Francis Giofre Jr. Saturday afternoon Jan. 10, 2026. Petrucci set bail at 10 percent of $50,000.00. Giofre Jr. was released later the same day after posting the court mandated $5,000.
According to the probable cause last July a female complainant/victim reported a string of sexual assaults that have occurred over at least five years while the victim was falling asleep or asleep to Bristol Twp. Police Department.
Detective Emilyann Maialetti interviewed the victim at police headquarters. The woman told the detective that she and her boyfriend, Giofre Jr, have lived together since 2015 and moved to Bristol Twp. in 2018. They have three children together.
On New Years Eve of 2020, the victim told police, the couple were drinking at their residence in Bristol Twp. She said she blacked out and woke up to find Giofre Jr. lying on top of her and having sex with her. She recalls saying “no” and “stop” while trying to move away, but Giofre Jr. held her down telling her it was okay, so she eventually gave up fighting
According to the criminal complaint the victim said that around 2021 she would occasionally be awakened by Giofre Jr. sexually touching her while she slept. She told Giofre Jr. no and explicitly expressed that she did not want to be touched in that way. The victim stated that sometimes Giofre Jr. would start to touch her while she was still falling asleep. She would move to get away and he would quickly take his hand back as though he was trying not to get caught.
The victim, according to police, reported she would wake up to discover Giofre Jr. touching her breasts, vagina, and buttocks with his hands. She stated that sometimes she would sleep on her back and Giofre Jr would move her blanket and pull her shorts and underwear to the side. He would expose her vagina and touch it with his hands. She also advised that on some occasions the defendant would rub his penis against her body through his clothing. The victim advised that she had also woken up with Giofre Jr’s fingers inside her, penetrating her vagina. She told the detective that she has also woken up to Giofre Jr. touching her vagina and masturbating at the same time.
The victim told investigators when there was an occurrence she would tell Giofre no, or she would leave the bedroom and sleep on the couch. She stated the behavior wouldn’t occur again for months so she knew she would have a break for a while and wouldn’t have to worry for a couple of months.
The woman told police since March of 2025 Giofre Jr’s behavior has escalated citing his attempts to touch her sexually while she was falling asleep or sleeping. The victim said Giofre Jr’s began touching her approximately three to four times a week, sometimes several times a night. She informed the detective that these assaults have occurred at least 30 times.
The victim told police, said she wakes up panicked every morning.
She told the detective she viewed Giofre Jr’s Google account and found a picture he took on May 5, 2025, of her vagina while she slept, according to police.
She also said that on the night of July 17, 2025, her mother stopped by the couple’s apartment while Giofre was home. The victim told the detective that he and her mother had a brief conversation and her mother could tell something was off because of his behavior. Due to this her mother confronted Giofre asking what was wrong. He explained to her that he was touching the victim while she was awake and she did not like it so he was moving out. The victim said Giofre Jr. later informed her he had spoken with her mom and told her the truth.
The victim provided a screenshot of her text conversation with Giofre Jr. in which he states the following: “And this is what I said to your mom I told her that I’ve been touching you while u sleep and that it’s been a recurring thing thru out our relationship that you expressed to me that you don’t like it and have pleaded with me to stop and I never did so you don’t feel safe with me in the house and I was leaving.”
Giofre Jr. is scheduled to appear for a preliminary hearing on Feb 3 to answer to the charges. He has no attorney of record as of publication time.
