Virginia Beach Man Charged for Smoking Blunt, Possessing Unlicensed Guy at Truman High School Parking Lot

A Virginia Beach man was sitting in his parked vehicle on Bristol Township School District Property after hours and a observant office on patrol stopped to investigate landing him a spot as a guest at Bucks County Correctional.

According to police,  on July 23 at approximately 9:44 p.m., an officer  observed  a vehicle in the Truman High School parking lot. The officer placed his patrol vehicle approximately 10 yards to the left hind quarter of the running vehicle and shined his spotlight into the parked vehicle. The driver put down his window and a cloud of smoke escaped, said police. As the officer approached, he observed the vehicle was full of smoke and smelt of burnt marijuana. The driver, identified as Hezekiaha Smith, 23, was smoking a marijuana blunt, court records allege.

Upon approaching, the officer, taking note of the driver’s dilated, glassy eyes, asked for the driver’s license, registration and insurance papers. Smith was asked for and gave up additional packets of marijuana. During the exchange, the officer reminded Smith to retrieve the requested credentials and he also observed a firearm concealed between the seat and center console. He then asked Smith to step out of the vehicle, according to the affidavit.

The officer administered the Standardized Field Sobriety Tests (SFST) and also a  Horizontal Gaze Nystagmus (HGN) Test. The probable cause showed Smith had no impairment doing the HGN and different test(s). Other test(s) he  showed some impairment.

Smith was arraigned on misdemeanor charges of an unlicensed concealed  firearm, a first offense DUI with controlled substance and impaired ability and two additional drug charges. Unable to post bail 10%/$25,000, he was remanded to Bucks County Correctional Facility(BCCF). His next court date is August 27, 2024, according to court paperwork.
