A Levittown man with a porn addiction who tried to sneak-a-peek of a partially clothed woman in a Kohl’s dressing room was charged by mail-summons earlier this month.
According to the criminal complaint filed by Lower Makefield Township Police, officers were dispatched to Kohl’s Department Store, 1641 Big Oak Road, on February 17, 2025 at approximately 1:11 p.m. A woman 911 caller said she thought she had been recorded while undressing and re-dressing in the clothing outlets fitting room.
Police arrived on scene and met with the victim. She related that while getting dressed, she noticed a white hand holding a cellular telephone under the fitting room stall. She said that at the time she saw the phone, she had just pulled on her pants. Immediately preceding her seeing the phone she had been in a state of partial nudity. She was in a place where she had a reasonable expectation of privacy and safety. She described the phone as being “red” or having a “red case” around it, according to court records.
After seeing the phone, she quickly opened the door and saw a white male dressed in black running away. She said she recognized him as the same person who pulled in and parked next to her in the parking lot.
Responding officers, according to the probable cause, obtained video surveillance footage from Kohl’s. In this footage, the victim enters a fitting room followed by a male who fits the victim’s description. Later, the same male (subsequently identified as Hunter Capps) is seen quickly exiting the fitting room area.
Upon his exit from the store at 12:47 p.m., police said, Kohl’s security surveillance captured a very clear picture of Capps’ face. He is a white male, with brown hair and a handlebar styled mustache. Surveillance also captured Capps entering a red sedan. Through automatic license plate readers (ALPR) investigators were able to synchronize the times between Capps exiting the store and the vehicle traveling through a near-by ALPR. The vehicle is a red Toyota registered to Capps, police said.
Six days later, on February 23, 2025, Kohl’s notified officers that they believed Capps was back in the store. Officers responded and observed the red Toyota. Officers noticed the registration and inspection were expired, and initiated a traffic stop. Upon contact, Officer Golder noticed Capps had a red phone between his legs. Capps provided the officer with his phone number. Using law enforcement databases, investigators discovered the phone number is registered to Cellco Partnership doing business as Verizon Wireless and is assigned to Capps, the criminal complaint alleges.
Detectives executed a search warrant on February 27 to take possession of Capps’ cellular telephone. Capps was presented with the warrant to seize and search his device. He asked detectives to come in, citing neighbors’ leering eyes who learned of a police presence at his home, police said.
Detective Lange spoke with Capps about the alleged events outlined in the search warrant provided to Capps. He agreed to let investigators record the conversation, according to court records. Capps confirmed he was at the Kohl’s in Yardley alone on February 17. He stated he was in the fitting room but did not realize that he was on the women’s side. He heard a woman next to him and his “addiction” got the best of him. Capps said he has a pornography addiction and that he has been trying to get help for it. He said that “risky behavior” escalates his addiction. The urge came on and Capps placed his phone under the stall. He admitted to taking both still and video images of the woman in the stall next to him, police wrote in court records.
Capps confirmed that he was caught in the act by the victim and confronted. He quickly exited the store because he was scared of being caught. At some point after getting to his car, Capps told Det. Lange that he deleted the video and pictures from his device. Capps admitted to doing this same behavior once before but was not completely sure of the time or place, the probable cause alleges.
On February 27, Det. Lange performed data acquisition on an iPhone 12 mini in a red case that had been seized earlier that day from Capps. At the time of acquisition, Det. Lange located evidence confirming the phone belonged to Capps and also located evidence on the device consistent with the statements provided by both the victim and Capps, detectives said in court papers.
Capps was charged with misdemeanor counts of invasion of privacy, disorderly conduct and harassment. He is scheduled to appear for a hearing on the charges on April 22 in Morrisville District Court. As of publication time, Capps has no attorney of record.
