A Fairless Hills man was charged and released last week accused of lying on official documents in an attempt to buy a handgun in Tullytown.
The incident originally played out earlier this year in April, police said. On September 16, Tullytown Borough Police received information from the Pennsylvania State Police Firearms Division. DeAngelis Holmes, 65, attempted to purchase a handgun on April 11, 2024, from Mike’s Sporting Goods Inc. in Levittown. According to police, information received from State Police showed he was denied because he has number of felony convictions and a protection from abuse order filed against him, prohibiting him from purchasing or possessing a firearms, according to official records.
Holmes applied at Mike’s Sporting Goods Inc. in an attempt to purchase a “Taurus G3C.” 9mm Caliber handgun. The applications in question are the ATF Form 4473 (5300.9) Part 1, Revised August 2023 and the Pennsylvania State Police Application/Record of Sale. Holmes provided personal information that is related to his unique identifiers.
The forms ask “Have you ever been convicted in any court, including military court, of a felony, or any other crime for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation. This question was answered “No”. On a second federal form it asks “Are you subject to a court order, including Military Protection Order issued by a military judge or magistrate, restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner. This question was answered “No”. On a Pennsylvania State Police Application/Record of Sale form, it asks if the applicant has been charged with and/or convicted of a crime where the maximum imprisonment could exceed one year. The yes box was scribbled out and the no box was selected with the applicant’s initials underneath of it, said police in court records.
Holmes’ convictions and a protection order against him filed are out of Trenton, New Jersey, Sgt Andrew Bunda said, noting in the probable cause he was denied firearm purchases on three previous occasions. He challenged two of the denials but they were upheld, police said.
Holmes was charged with felony false written statement(s) and misdemeanor statement under penalty. He was arraigned and released on unsecured bond scheduled to appear for a court hearing on October 29.
