Bucks County District Attorney Joe Khan announced Thursday he is joining a bipartisan coalition of District Attorneys from seven Eastern Pennsylvania counties to bring a major consumer protection lawsuit against secondary ticketing giant Vivid Seats, Inc which is a ticket provider for the Excite Center at Parx Casino in Bensalem.
The lawsuit, originally filed by the Monroe County District Attorney’s Office in the Court of Common Pleas in Monroe County, alleges that Vivid Seats systematically violates Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. The legal action targets deceptive pricing schemes, commonly known as “drip pricing” and hidden “junk fees,” that manipulate buyers and obscure the true cost of event tickets.
According to the complaint, Vivid Seats uses deceptive online tactics and digital “dark patterns” to lure consumers with artificially low ticket prices, only to tack on mandatory fees at the final stage of checkout. The suit highlights three main deceptive practices at the center of the scheme: drip pricing, fee misrepresentation, and the deliberate concealment of total costs. Together, these undisclosed add-ons can increase the final price by as much as 80 percent above the advertised rate.
In practice, Vivid Seats advertises an initial low price to get buyers through the checkout flow, only to incrementally reveal mandatory fees near completion. To reinforce this bait-and-switch strategy, the platform uses misleading countdown timers and interface layouts designed to create urgency, pushing consumers into finishing transactions before they realize how much the total price has escalated. By concealing true total costs until the final second, the company actively prevents buyers from fairly comparison shopping across competitors or local box offices.
With football season in full gear, demand for game tickets is soaring. In Bucks County, secondary ticket platforms like Vivid Seats regularly resell tickets for events at popular local venues, including the Xcite Center at Parx Casino, the Bucks County Playhouse in New Hope, and the Sellersville Theater. Furthermore, given our close proximity to Philadelphia, thousands of Bucks County residents routinely travel into the city for major concerts, shows, and sporting events featuring the Phillies, Eagles, Sixers, and Flyers. Whether attending a neighborhood performance or heading to Lincoln Financial Field on game day, local consumers looking for tickets are frequently targeted by these deceptive pricing practices, driving up out-of-pocket costs for entertainment in our region.
To address these violations, the lawsuit seeks an immediate injunction to halt Vivid Seats’ deceptive pricing practices across the Commonwealth. In addition to forcing price transparency, the legal action aims to secure full restitution for affected consumers, statutory civil penalties, and the recovery of legal costs.
“When hardworking Pennsylvanians budget their money to take their families to a concert, game, or theater performance, affordability and honest pricing matter,” said Bucks County District Attorney Joe Khan. “Hiding massive fees until the final second isn’t just bad business. It is deceptive, it is illegal under Pennsylvania law, and it directly undermines affordability for families across our county and state. We are joining this coalition to hold online ticket brokers accountable and ensure fair transparency in the marketplace.”
The expanding multi-county coalition reflects a growing push by Pennsylvania prosecutors to enforce state consumer protection laws against digital platforms that target residents.
District Attorneys joining the action highlighted the shared impact on working families and the importance of holding secondary ticket sellers accountable across county lines:
“Families in Wyoming County deserve honest, straightforward pricing when they purchase tickets for live sporting events, concerts and shows,” Wyoming County District Attorney Joseph C. Peters said. “By joining this bipartisan coalition, we are standing up for consumer rights, protecting hard-earned dollars, and ensuring ticket platforms operate with total transparency.”
“This fleecing of consumers is exactly the circumstance where we as District Attorneys have an opportunity to protect our constituents and victims from predatory practices,” Luzerne County District Attorney Samuel M. Sanguedolce said. “I’m proud to stand beside DAs Mancuso and Khan and all those prosecutors utilizing our consumer protection authority to deter these types of deceptive practices.”
The lawsuit was spearheaded by the Monroe County DA’s Consumer Protection Division, assisted by consumer rights law firm Tycko & Zavareei LLP.
