President of Levittown Staffing Agency Charged with up to 122 Felonies for Lack of Workers Comp. Insurance

A Levittown woman who is the president of an employment staffing agency is being charged with up to 122 felonies for failure to maintain workers compensation insurance and doing so intentionally, a criminal complaint filed last week alleges

According to a criminal complaint filed by state investigators last week, the President of Express Staffing, LLC, Stephanie Montgomery, of Levittown, faces up to seven years in prison and potentially thousands in fines for failure to insure required workers compensation protections for employees.

Express Staffing LLC, according to Department of State online records, is still an active business located at 2081 Hartel Avenue in Bristol Township. 

The criminal complaint alleges the following:

  • Certificate issued by the Pennsylvania Workers Compensation Rating Bureau indicating the defendant was not insured from June of 2015 to September of the same year. 
  • From June 1 2015 through September 30, 2015 Express Staffing,LLC and Montgomery  employed workers  and was not an exempt self insurer from holding workers compensation insurance.
  • Department of Labor state workers insurance fund notification of insurance cancellation
  • Certified copy of a claim petition against 1 Express Staffing, LLC
  • Two certified copies of decision of workers compensation claims certified by a state compensation judge in 2016 and 2017.

Additionally, state investigators say each day’s violation constitutes a separate offense for Montgomery and Express Staffing, LLC amounting in 122 felonies charged.

According to Pennsylvania Statute, if proven to have been done willfully, third degree misdemeanors may result in a penalty of up to one year in prison and a fine of $2,500 per offense.  Third degree felonies may result in a penalty of up to seven years in prison and a fine of $15,000 per offense.

Montgomery is scheduled to appear to answer the charges in a preliminary hearing on August 8 in front of Magisterial District Judge Kevin P. Wagner.
