Levittown Man Charged with Assault of Police Officers After Domestic

Falls Township Police were dispatched to a domestic incident in Levittown late Sunday and were about to leave when a confrontation developed between the male suspect and officers leading one man in jail and officers spat on by him.

The scene played out, last Sunday night 11 p.m., when  officers were dispatched to Nestingrock Lane in Levittown for a report of a domestic incident  in progress.

Police arrived and spoke to the suspect, identified as Matthew Fazio. He appeared to be somewhat calm, as one officer overheard him telling another officer that he told the victim he would leave for the night, according to court records. 

As one officer spoke with Fazio, two other officers walked to a back bedroom and found the victim lying on a bed with a dog. She was uncooperative but admitted to being in a verbal dispute with Fazio and adding that he wasn’t normally this bad, the probable cause says. 

As one officer looked at her, she appeared to have some red marks and bruising on the right side of her face and neck area. However, when questioned, she denied any physical abuse occurred and blamed her dogs, said police. 

After speaking with the victim, and because she was unwilling to admit any abuse, an officer was going to get a domestic violence packet for her and leave. However, when police walked back into the kitchen/dining area, Fazio, who was sitting in a chair, became upset and began yelling at the police calling them “n****rs”  and, out of nowhere, spit on one officer. From where another officer stood it looked as if the spit hit the officer in the chest, the affidavit alleges. 

Once Fazio spit, all three officers attempted to take him into custody. He became increasingly combative, resisting the efforts of officers to control as Fazio resisted   As three officers struggled to get him into custody, one officer was able to get his left arm into a handcuff, another officer struggled to get Fazio’s right arm cuffed as he was holding onto his pants. A third officer was holding Fazio’s head down so he wouldn’t spit on the officers again. During this struggle two of the officers’ body cameras fell off. 

Once Fazio was in handcuffs, police attempted to walk him outside, however, while walking towards the door he attempted to spit on officers again. He missed but as police continued to escort him towards the door he hit his head on the glass storm door.

Exiting  the residence, police continued to struggle with Fazio causing one officer and Fazio to fall to the ground.  The officer fell on his shoulder and side, unaware of how or why Fazio fell. As police fought with Fazio to get him back to his feet, and walk him to a police vehicle, he spit once more on the officer that was spat on before, police believing that officer was spat on in the head area.

As they got Fazio  into the vehicle, he continued to yell at police threatening he was going to beat them up.

Fazio was transported to Jefferson Bucks Hospital to be medically cleared for incarceration. When the reporting officer arrived and as police waited outside, the reporting officer could hear Fazio yelling inside the car and banging his head on the partition. As police took Fazio out of the vehicle, the police put him in a wheelchair and put a mask on him to prevent spitting, however, Fazio kept removing it.

As one officer pushed the wheelchair inside the hospital, Fazio continued to yell and scream as he spit on a different officer, hitting him in the head area.

When police moved Fazio into the hospital room, he continued to fight with police and staff and had to be restrained. Fazio continued to attempt to spit on staff and officers. He was yelling calling police “n****rs”  and causing a scene as staff and police attempted to restrain him. While doing so, he spit on one officer striking him in the face.

Fazio was arraigned Monday afternoon on five felony charges of assault of law enforcement officer, and misdemeanors of simple assault, resisting arrest, and disorderly conduct. He was remanded to Bucks County Correctional in lieu of 10 percent of $250,000.00 with a court date scheduled for January 21.
